Record of the minutes of a regular meeting of the City Council of the City of Minto, Walsh County, North Dakota, held on July 2, 2007 at 7:00 PM at the Minto City Auditor’s Office.
Mayor John Riskey called the meeting to order. Present were Mayor John Riskey, Councilmen Lee Gudajtes, Heather Narloch, and Kevin Schuster. Absent was Councilman Brad Narloch.
Open petitions from the public were heard.
Lynelle Shutt proposed closing off the City Park for a paint gun war activity. She has started looking into the possibilities of holding this type of activity. She will continue to research what needs to be done.
Kelly Kowalski and Leo Misialek voiced a complaint against their neighbor, Jerry Guthmiller. He has abandoned vehicles in the backyard and doesn’t keep his yard mowed. A letter will be sent to Mr. Guthmiller.
Wally Ebertowski thanked the Council for taking action to get his neighbors’ yards mowed.
Minutes from the regular meeting held on June 4, 2007 were submitted for approval. On motion by Schuster, seconded by Gudajtes, and carried. The minutes were approved.
Committee reports were given.
Animal Warden:
Complaints were received regarding several barking dogs. Letters were sent to Camille Bass, Coleen Donelon, and Dan Dunnigan.
Planning & Zoning:
The following building permit applications were discussed:
Councilman Brad Narloch joined the meeting.
Streets, Grounds, & Lights:
Civil Contracting is still working on the landscaping and drainage problems in the Stoltman’s Subdivision.
Crack sealing will begin next week.
There are still two fire hydrants left to fix as Mr. Shutt ran out of parts.
Forestry:
A crabapple tree has been purchased for the Lisa Norton/Ron Nelson property.
A discussion was held concerning sponsoring a housing project within the City of Minto. Diane Weick of F & L Development was unable to be present but will be in the area later in the month. A special meeting will be called when Ms. Weick can be present to explain what this type of project would entail. After discussion, the following resolution was presented for review:
RESOLUTION 2007-001
RESOLUTION DECLARING A NEED FOR A HOUSING AUTHORITY IN THE CITY OF MINTO, NORTH DAKOTA
BE IT RESOLVED by the City Council of the City of Minto, North Dakota (the “City”), as follows:
Section 1. Policy and Purpose.
1.01. For the purpose of providing decent, safe and sanitary housing, including single-family and multifamily residential units for the citizens of the City, there is created in the City by Chapter 23‑11 of the North Dakota Century Code (the “Act”) a housing authority of the City.
1.02. The housing authority of the City may not transact any business nor exercise any powers granted by the Act until the City Council declares that there is a need for a housing authority to function in the City.
Section 2. Findings.
2.01. It is hereby found and determined that there is a shortage of safe and sanitary dwelling accommodations in the City available to persons of low or moderate income at rentals they can afford to pay.
2.02. It is hereby found, determined and declared to be necessary and in the best interest of the City for a housing authority of the City to organize and function in the City and to exercise all powers and authority granted to a housing authority by the Act.
Section 3. Approval and Authorization.
3.01. The City hereby establishes the “Housing Authority of the City of Minto, North Dakota” (the “Housing Authority”) and authorizes it to organize and exercise all powers granted to it pursuant to the Act.
3.02. The Mayor shall be promptly notified of the adoption of this Resolution Declaring a Need for a Housing Authority in the City and that, pursuant to N.D.C.C. Sections 23‑11‑05 and 23‑11‑06 of the Act, the Mayor be, and hereby is, directed to file in the office of the City Auditor a certification of the appointment of five persons to serve as Commissioners of the hereby established Housing Authority of the City, one of whom shall be appointed Chair, and such certification shall be conclusive evidence of the due and proper appointment of such Commissioners.
3.03. The City Auditor is hereby authorized and directed to deliver a certified copy of this resolution to the duly appointed first Chair of the Commissioners of the Housing Authority of the City of Minto.

On motion by B. Narloch, seconded by Gudajtes, carried. Approved Resolution 2007-001.
Several estimates have been received to move the raw water line on the west side of the City. On motion by B. Narloch, seconded by H. Narloch, carried. Approved to move forward with the project by requesting bids according to specifications. Mr. Shutt will contact the ND State Health Department to see what needs to be done to meet their requirements.
Mayor Riskey will be attending the 150th Celebration for Minto Township in Ontario. Housing and meals will be provided by the hosts. On motion by Gudajtes, seconded by B. Narloch, carried. Approved to pay for Mayor Riskey’s airfare and rental car.
The contract with Tri-County Crisis Intervention was reviewed. On motion by B. Narloch, seconded by Schuster, carried. Approved the fee for service contract with Tri-County Crisis Intervention.
Items for the 2008 budget were discussed. Mrs. Ulland was directed to research what the going rate for office rental space is.
The Council was notified there will be a consignment farm auction in Minto on July 12th. On motion by Schuster, seconded by B. Narloch, carried. Approved to close off the 100 block of Harvey Avenue for the duration of the auction. Scott Schuster will need to notify all business owners the street will be closed off.
B. Narloch informed the Council of a grant the Airport Board has received to upgrade the runway.
A gaming site authorization for Grafton Curlers, Inc. was reviewed. On motion by Schuster, seconded by H. Schuster, carried. Approved a gaming site authorization for the Grafton Curlers, Inc. to conduct games of chance at the Harvey Avenue Saloon.
Marian Huggins will be asked to move trees on her berm that are blocking the view of the stop sign.
The Council was informed the fence along Minto Grain’s east boundary is grandfathered in as it was present before Ordinance #182 was adopted. Minto Grain is required to keep the area neat.
Mrs. Ulland notified the ND State Water Commission of a possible problem with fill material being placed in the floodway area.

Record of the minutes of a special meeting of the City Council of the City of Minto, Walsh County, North Dakota, held on July 18, 2007 at 7:00 PM at the Minto City Auditor’s Office.
Mayor John Riskey called the meeting to order. Present were Mayor John Riskey, Councilmen Lee Gudajtes, Heather Narloch, and Kevin Schuster. Absent was Councilman Brad Narloch.
Diane Weick, F & L Development, LLC, was present to explain the Essential Function Bond Housing program to the Council. The next step in the process is to appoint a five-member Housing Authority Board. Ms. Weick will be in the area again on August 1, 2007. It was agreed to hold an informational meeting to see if there is enough interest in a moderate income housing project to move forward.
There being no further business, on motion by Gudajtes, seconded by Schuster, carried. The meeting was adjourned. The next regular meeting will be held on August 6, 2007 at 7:00 PM. The Planning and Zoning Committee will meet on August 6, 2007 at 6:30 PM. A public informational meeting will be held on August 1, 2007 at 7:00 PM.
